Obligation of an foreigner to undergo a medical examination at the state border in connection with communicable diseases

Abstrakt: ¹ Lekárska prehliadka cudzinca v súvislosti s prenosným ochorením je v súčasnosti, ale aj do budúcnosti, aktuálnou témou. V súvislosti so skúsenosťami s pandémiou Covid-19 je zrejmé, že bude potrebné zaoberať sa uvedenou problematikou. Príspevok sa zaoberá povinnosťou cudzinca podrobiť sa lekárskej prehliadke v súvislosti s prenosnými ochoreniami. Rozoberá jednotlivé prípady, ktoré môžu nastať, ako aj navrhuje ich riešenie.

Abstract: An foreigner's medical examination in connection with a communicable disease is a current topic, but also a topic in the future. In the light of the experience with the Covid-19 pandemic, this issue will need to be addressed. The paper deals with the obligation of an alien to undergo a medical examination in connection with communicable diseases. It discusses the individual cases that may occur, as well as proposing their solutions.

Some of the philosophical backgrounds of extreme emergency and necessary defense

Anotácia: Príspevok sa zameriava na tému politicko-právnych východísk krajnej núdze a nutnej obrany. Skladá sa z dvoch relatívne samostatných kapitol, z ktorých každá sa venuje východiskám jednej z dvoch spomenutých okolností vylučujúcich protiprávnosť činu. Pomôcť čitateľovi pochopiť podmienky krajnej núdze a nutnej obrany v rôznych právnych úpravách v spektre ich filozofických východísk a takisto určiť si ich dôsledky z hľadiska trestného práva. To sú základné ciele, ktoré by mal príspevok naplniť.

Annotation: The paper focuses on the topic of philosophical bases of extreme emergency and necessary defense. It consists of two relatively separate chapters, each of which deals with the basic points of one of the two mentioned circumstances excluding the illegality of an act. To help the reader understand the conditions of extreme emergency and necessary defense in the various national legislations in the spectrum of their philosophical backgrounds and also to determine their consequences from the point of view of criminal law. These are the basic goals that the article should fulfillň

Assembly law and organization of public events and their impact on the activities of the Police Force and public administration

Abstrakt: Autor sa v štúdii venuje zhromažďovaciemu právu v zmysle jeho zakotvenia v Ústave Slovenskej republiky, a v ďalších zákonoch súvisiacich so zhromažďovacím právom a organizovaním verejných podujatí, ktoré majú vplyv na činnosti Policajného zboru. Policajný zbor musí dohliadať na konanie zhromaždenia a v prípade narušenia verejného poriadku zasiahnuť. Z toho pramenia mnohé konfliktné situácie medzi právom na zhromažďovanie a snahou udržiavať verejný poriadok a verejnú bezpečnosť. Autor sa pozerá na problematiku z hľadiska pozitívneho práva.

Abstract: The author deals with the right of assembly in the sense of its anchoring in the Constitution of the Slovak Republic, and in other laws related to the right of assembly and the organization of public events that affect the activities of the Police Force. The police force must supervise the proceedings of the assembly and intervene in the event of a breach of public order. This gives rise to many conflicts between the right of assembly and the pursuit of public order and public security. The author looks at the issue in terms of positive law.

Abstract: The growth of a mandate of the European Border and Coast Guard Agency, also called Frontex is very closely linked with changes in area of migration. Specifically, the greatest impact on the need for various flexible changes were caused by illegal migration and its flow. The European Border and Coast Guard Agency went through significant changes and the area of responsibilities has been extended. The author wants to refer to these significant developments and the importance of the Agency’s role in border management, border protection and control. Because the illegal migration is also a flexibly changing phenomenon, the European Border and Coast Guards Agency’s mandate also responds to these changes.

Theory of migration and asylum problem at the level of the Slovak Republic

Abstrakt: Autorka v príspevku objasňuje problematiku migrácie a azylu na úrovni Slovenskej republiky. Čitateľovi stručne vysvetľuje základnú pojmológiu úzko spätú s riešeným problémom. Venuje sa medzinárodnej ochrane a možnostiam jej poskytnutia podľa unijného práva. Rieši nelegálnu migráciu a spôsoby akými na ňu dokážu reagovať oprávnené orgány Slovenskej republiky. V nesplodenom rade sa zaoberá priebehom azylového konania a možnosťami, akými sa so žiadateľmi o azyl pracuje.

Abstract: In the article, the author deals with the problem of migration and asylum at the level of the Slovak Republic. Explains the basic concepts of the problem. It deals with international protection and the possibilities of its provision under EU law. It addresses illegal migration and the ways in which the authorized authorities of the Slovak Republic can respond to it. It deals with the course of the asylum procedure and work with asylum seekers.

Selected characteristics and education at the Academy of the Police Force during the pandemic

Abstrakt: Táto práca pojednáva o problémoch, ktoré vznikli ako dôsledok prechodu na dištančnú výučbu v rámci Akadémie Policajného zboru počas pandémie COVID-u. Cieľom je identifikovať konkrétne problémy spojené s výukou teoretických predmetov, praktických predmetov a odbornou praxou, a navrhnúť ich riešenie. Špeciálna pozornosť je venovaná optimalizovaným metódam skúšania a preverovania vedomostí a zručností študentov za pomoci online nástrojov.

V technických a policajných vedách je obzvlášť rýchly vývoj, či už v komerčnom sektore, ale aj vo vede, výskume a vzdelávaní. Rýchlosť nástupu nových metód, procesov a technológií vedie k rýchlejšiemu zastarávaniu príslušných učebníc, skrípt a ďalších študijných materiálov. Tým pádom je nevyhnutné častejšie aktualizovanie týchto materiálov, prípadne aj zmena ich formy. V tejto práci sú zhrnuté návrhy a analýzy pre vyučujúcich aj študentov, ktoré majú za cieľ napomôcť k lepšej adaptácii na online pedagogický proces, vrátane užitočných tipov pre online prednášanie s použitím moderných nástrojov.

Výučba na Akadémii Policajného zboru zahŕňa teoretické predmety, praktické predmety a tiež odbornú prax. V tejto práci je zároveň analyzované riziko a dopad prípadného výpadku tejto odbornej praxe absolventov. Výuka je štandardne zakončená určitou formou skúšania. Práca sa venuje dvom vybraným prístupom k online skúšaniu. Konkrétne ide o tzv. test s výberom odpovedí a ústne skúšanie. Porovnané sú aj dištančné, kombinované a prezenčné spôsoby vyučovania, z pohľadu prednášajúceho aj z pohľadu poslucháčov. Anonymné odpovede respondentov na vybrané otázky dotazníka sú spracované metódami matematickej štatistiky.

Abstract: This work approaches some problems of switching to remote education at the Academy of the Police Force during the COVID pandemic. The aim is to specify the problems regarding theoretical subjects, practical subjects and professional practice, and to propose their solutions. A special attention is paid to the optimalized methods of examination and assessment with the use of online tools.

Technical and police sciences are quickly developped in commercial sector as well as in education. It results in fast obsolescence of books, scripts, and other study materials. Therefore, it is necessary to enhance the actualization, and/or form modification of these study materials. A set of recommendations for lecturers, leading to better adaptation to the online pedagogic process, is proposed, including useful tips for online teaching with the use of modern tools.

The education process at the Academy of the Police Force includes theoretical subjects and practical ones, and also professional practice. Potential risks and consequencies of the lack of practical experience of graduates is analysed in this work. The education is generally completed by any form of examination. Two chosen online examination approaches are discussed in this work. Namely it is either test with answer choice or oral examination. Remote, combined and face-to-face forms of education are compared both from the teachers’ and students’ points of view. Anonymous answers on chosen questions from a questionnaire are analyzed by the methods of mathematical statistics.

Abstract: The aim of the article is to take a closer look at controversial area of international law that is not expected to be clarified and determined in the near future. The privileges and immunities of international organizations have been and are the subject of much debate in both science and judicial practice. As in other areas of "life" of international organizations, there are significantly different views of authors and national and international courts on privileges and immunities of international organizations due to the fact that the law of international organizations is still imperfect and lacks certainty as well as complex international codification of privileges and immunities of international organizations and their functionaries.

Institute of strict liability in road traffic and its implementation in selected EU countries II. - Hungary, Poland, Italy

Abstrakt: Predmetný príspevok pod názvom „Inštitút objektívnej zodpovednosti v cestnej premávke a jeho realizácia vo vybraných krajinách EÚ II.“ je voľným pokračovaním I. časti príspevku, v ktorej autor ozrejmoval čitateľovi systém fungovania inštitútu objektívnej zodpovednosti v cestnej premávke v krajinách ako Česká republika a Rakúsko. V tejto II. časti príspevku sa pozornosť autora sústreďuje na analýzu právnej úpravy v súvislosti s vyvodzovaním objektívnej zodpovednosti v ďalších krajinách Európskej únie ako napr. Maďarsko, Poľsko či Taliansko. V neposlednom rade ponúka príspevok čitateľovi aj aktuálny vývoj dopravnej nehodovosti na cestách uvedených krajín.

Abstract: This article entitled "Institute of Strict Liability in Road Traffic and its implementation in selected EU countries II." In this II. part of the paper, the author's attention is focused on the analysis of legislation in connection with the derivation of strict liability in other countries of the European Union, such as. Hungary, Poland or Italy. Last but not least, the contribution also offers the reader the current development of traffic accidents on the roads of these countries.

Abstrakt: Predmetný príspevok pod názvom „Inštitút objektívnej zodpovednosti v cestnej premávke a jeho realizácia vo vybraných krajinách EÚ I.“ je autorom z rozsahového hľadiska rozdelený na II. časti, pričom v predkladanej I. časti príspevku ozrejmuje autor systém fungovania inštitútu objektívnej zodpovednosti v cestnej premávke v krajinách ako Česká republika a Rakúsko. Autor taktiež analyzuje právnu úpravu v súvislosti s vyvodzovaním objektívnej zodpovednosti a v neposlednom rade aj aktuálny vývoj dopravnej nehodovosti na cestách uvedených krajín. Pokračovaním bude II. časť, v ktorej sa autorova pozornosť sústredí na ďalšie vybrané krajiny EÚ - Maďarsko, Poľsko či Taliansko.

Abstract: The article entitled "Institute of strict liability in road traffic and its implementation in selected EU countries" is divided by the author into II. part, while in the presented part I of the article the author clarifies the system of functioning of the institute of strict liability in road traffic in countries such as the Czech Republic and Austria. The author also analyzes the legal regulation in connection with the derivation of strict liability and, last but not least, the current development of traffic accidents on the roads of these countries. The continuation will be II. part in which the author's attention is focused on other selected EU countries - Hungary, Poland or Italy.

Victims' rights and legal status during the investigation phase of the criminal proceedings in the Slovak republic and Czech republic - comparative study

Anotácia: V príspevku sa snažíme hlbšie načrieť do platnej právnej úpravy zákona č. 274/2017 Z. z. o obetiach trestných činov a o zmene a doplnení niektorých zákonov v znení neskorších predpisov, ako i zákona č. 415/2003 Sb. o obetiach trestných činov a o zmene niektorých zákonov v podmienkach Slovenskej, ako i Českej republiky. Hlavným cieľom článku je, na základe analýzy súčasného stavu de lege lata, ako aj porovnaním jednotlivých právnych úprav pomoci a ochrany obetí trestnej činnosti a tiež komparáciou označených právnych predpisov poskytnúť návrhy na zlepšenie prístupu k obetiam trestnej činnosti na území Slovenskej republiky. ¹

Summary: In the article we try to look deeper into the Act No. 274/2017 Coll. on victims of crime as well as into the Act No. 415/2003 Coll. on victims of crime in conditions of the Slovak and Czech republic. The main goal of the article is to analyze the current state of de lege lata and to compare the legislative field of help and protection of the victims as well as to compare the above-mentioned legal acts with the aim of the proposal of better attitude towards the victims of crime in the Slovak republic. ¹
